Reporting Officer's Narrative

REPORTING OFFICER'S NARRATIVE(Brief narrative of the facts surrounding the offense and the arrest.)

At 11:30 a.m. Unit #304 (Deputy Fred Willits) was dispatched to a residence on County Road 169 in Alesville to respond to a triggered silent security alarm. Reporting Officer (R/O) Willits arrived at the scene at 11:38 a.m.

Upon arrival at the residence, R/O Willits observed no signs of forced entry. However, upon exiting his vehicle, he noticed a young man coming out through a back gate. Upon seeing the police vehicle, the young man immediately put his hands in the air and said something unintelligible. R/O Willits approached the man after instructing him to kneel on the ground and keep his hands up. A search incident to arrest found that the suspect was neither armed nor in possession of any burglary tools.

At this point, R/O requested backup, and Unit #224 (Officer Steve Harding) was dispatched to the scene and arrived at 11:44 a.m. The suspect then identified himself as Brandon Ebner (Person 1), a friend of the family that lives at the residence. The suspect was informed that a security alarm at the residence had been triggered and was questioned about what he was doing there. The suspect refused to provide any explanation, saying only that he wouldn't talk until he could speak to a detective.

R/O Harding then transported Mr. Ebner to the detective bureau for questioning related to this incident while R/O Willits conducted a search near the home's exterior where he first observed the suspect exiting the gate. During the course of that search, R/O Willits found a pry bar on the ground and damage to the easternmost rear window consistent with a forced entry. CSU was notified, and R/O Willits secured the scene until CSU arrived.

Throughout the time R/O was on scene, R/O made several attempts to alert any resident within the home of a law enforcement presence without success. R/O eventually notified Dispatch of the situation and was informed that detectives had contacted the homeowner and would follow up.

R/O Willits then attempted to talk to the next-door neighbors but received no response.

DEFENDANT'S VERSION/REMARKS(What did the defendant say?)

The suspect identified himself as Brandon Ebner and claimed to be a friend of the family that lives in the residence at 3 CR 169, Alesville.

Mr. Ebner said he wanted to speak to detectives and thereafter remained silent.
