REPORTING OFFICER'S NARRATIVE (Brief narrative of the facts surrounding the offense and the arrest.)
At 11:43 p.m., Dispatch received a non-emergency call reporting a disturbance of the peace at 121 Cedar Hill Drive. The caller, who identified himself as Warren Edwards (Person 1) of 119 Cedar Hill Drive, said a resident of 121 Cedar Hill Drive was using a powered garden trimmer and the noise was disturbing the neighbors and in violation of the neighborhood homeowners' association rules. Yoknapatawpha County Sheriff's Unit 225 (Officer Richard Squire) was dispatched and arrived at the scene at 11:43 p.m.
R/O responded to the location and observed an adult white male, later identified as Ambrose Garrett (Person 2), in the yard of 121 Cedar Hill Drive. Garrett was using a gas-powered leaf blower. R/O noted the exterior yard lights were on and shining brightly, illuminating the exteriors of several residences in the immediate area. R/O further observed a second adult white male, later identified as Warren Edwards (Person 1), in a first story window of the adjacent residence at 119 Cedar Hill Drive. Edwards appeared to be watching Garrett.
R/O approached Garrett in the front yard of 121 Cedar Hill Drive and requested that Garrett desist operation of the leaf blower. In response, Garrett was belligerent and abrasive. Garrett said that it was his yard and he would tend to it anytime he pleased. R/O advised Garrett that he was in violation of neighborhood association rules. Garrett responded that he was in charge of the association and could do what he wanted. Garrett continually asked if it was Edwards who called 911 to report the noise.
R/O informed Garrett that he was in violation of city and county noise ordinances and could be subject to citation and/or detention if he did not desist immediately. Garrett agreed to stop using the leaf blower and to turn off the bright exterior lights. Garrett ultimately complied with just a warning. No citation was issued. No arrest was made.
R/O observed Garrett cease operation of the leaf blower, enter the residence, and extinguish the exterior lights. R/O then proceeded to the residence at 119 Cedar Hill Drive and was met at the front door by Person 1, who identified himself as Warren Edwards. Edwards confirmed he was the individual who had reported the incident. Edwards expressed concern about Garrett's mood at the resolution of the incident. R/O indicated that no further difficulties were expected but instructed Edwards to contact the sheriff's department if any additional issues arise. Edwards thanked R/O for the assistance and re-entered his residence.
R/O left the scene at approximately 12:01 a.m. At 12:30 a.m., R/O conducted a drive-by at the incident location and observed no activity in the yard at 121 Cedar Hill Drive and no exterior lights illuminated.
