Reporting Officer's Narrative

REPORTING OFFICER'S NARRATIVE (Brief narrative of the facts surrounding the offense and the arrest.)

At 2:10 p.m., Reporting Officer (R/O) was conducting a routine foot patrol when he observed an adult male, later identified as Donald Wayne "Dewey" Devoe, loitering in front of the Oxford Cinema. Upon approaching Devoe, R/O detected a strong odor of marijuana.

Devoe consented to a search of his person. During said search, R/O recovered a small plastic zip-seal bag containing approximately one (1) ounce of a dried green vegetable substance.

R/O then took Devoe into custody and escorted Devoe to his vehicle. Devoe was handcuffed, informed of his rights, and transported to YCSD.

Environmental conditions at the time of arrest are as follows: Weather: Mostly cloudy; Ambient Exterior Temperature: 79º F / 26º C; Relative Exterior Humidity: 74%.

Transportation to the sheriff's department proceeded without incident. At 2:48 p.m., R/O turned Devoe over to Sheriff's Department personnel for processing and notified Narcotics Detective Mark Albrecht of the arrest.

At all times while in custody, Devoe appeared lucid and coherent. Although uncommunicative, Devoe was cooperative and seemed to comprehend what was happening to him.

 

DEFENDANT'S VERSION/REMARKS (What did the defendant say about the offense or his/her whereabouts at the time of offense?)

Devoe asked why he was being arrested and, upon being told, exclaimed, "Oh wow. Major bummer." Otherwise, Devoe refused to answer any questions until an attorney was present. However, Devoe did cooperate physically and did not resist in any way.
