REPORTING OFFICER'S NARRATIVE (Brief narrative of the facts surrounding the offense and the arrest.)

At 6:10 p.m., Reporting Investigators (R/Is) Detectives T. Armstrong and S. Murphy arrived at the arrestee's residence. Environmental conditions at the scene upon arrival are as follows: Weather: Fair; Ambient Exterior Temperature: 86º F / 30º C; Relative Exterior Humidity: 52%.

R/Is knocked on the door and the adult male known to them as Weldon Foyle answered. R/Is placed Foyle under arrest. Foyle was handcuffed and advised of his rights.

Foyle was then escorted by R/Is to their department vehicle. Transportation to the Sheriff's Department proceeded without incident.

At 6:31 p.m., R/Is turned the arrestee over to Sheriff's Department personnel for processing.

At all times while in custody, Foyle appeared lucid and coherent. Foyle was cooperative and seemed to comprehend what was happening to him.

 

DEFENDANT'S VERSION/REMARKS (What did the defendant say about the offense or his/her whereabouts at the time of offense?)

Foyle asked why he was being arrested and protested that the situation was not fair. During transportation to the station and during processing, Foyle repeatedly said, "You wouldn't be doing this if I had money" or words to that effect.

Foyle refused to answer any questions. However, Foyle did cooperate physically and did not resist in any way.

YOU ARE HEREBY COMMANDED, To arrest the above-named Defendant and bring him forthwith before the nearest available magistrate or other Judicial Officer of this State, to answer an indictment brought by the prosecutor in the attached affidavit, charging him with an offense of felony murder in the first degree against the person of Kristal Bentley Waterson on or about August 26, 2023 in the City of Oxford County of Yoknapatawpha. Herein fail not.

AFFIDAVIT

Personally appeared before me the undersigned Prosecutor, Calvin Dollarhide, Esq., who on oath says that to the best of his knowledge and belief, the above-listed accused, between the hours of 6:30 P.M. on the 26th of August, 2023 and 12:30 A.M. on the 27th of August, 2023 did commit the offense of Murder,  in Yoknapatawpha County, Mississippi, against Kristal Bentley Waterson, victim, and against the laws of the State of Mississippi.

Prosecutor makes this Affidavit in order that a criminal warrant may be issued for Accused's arrest.
