The Yoknapatawpha County Sheriff's Department obtained the court records for Nathaniel Nelson V. Church & Dwight Co., Inc., owner of Trojan brand condoms.
The case was filed on June 13, 2022.
In summary, Mr. Nathaniel "Hunter" Nelson (plaintiff) sued Church & Dwight Co. (respondent) for punitive damages due to the improper labeling of latex condoms.
Mr. Nelson alleged that, after donning a Trojan condom handed to him by his date, he suffered an allergic reaction causing him emotional suffering. Mr. Nelson established, by way of the attached affidavit from his physician, his allergy to latex rubber of the type used in respondent's condoms.
Mr. Nelson alleged that, because of the low light conditions and the lack of adequate glow-in-the-dark labeling, he was unable to determine that the condom contained natural rubber latex and that this alleged failure to adequately label the product constituted negligence on the part of the respondent.
In February 2018, the case was dismissed as being without merit.
Investigation of YCSD Case # 004378-27H-2023 is active and ongoing as of this date.

This letter confirms that Nathaniel Harrison Nelson has demonstrated an acute clinical immediate hypersensitivity reaction — commonly known as an allergic reaction — to latex proteins in materials derived from trees producing natural rubber latex (Hevea brasiliensis). Such diagnosis was made on 31 May 2022 using a skin-prick test at this facility and confirmed with results obtained from Natchez General Hospital Serology Laboratory, which conducted IgE allergy blood tests and confirmed the presence of IgE anti-latex antibodies.
When Mr. Nelson comes in contact with materials made of, containing, or that have been in contact or have absorbed natural rubber latex, his mucous membranes may absorb latex proteins. Mr. Nelson's immune system then produces antibodies that react immunologically with these antigenic proteins.
When exposed to latex proteins, like many latex-sensitive individuals, Mr. Nelson experiences severe reactions that begin with hives, congestion, tightening of the throat, and dizziness. However, in addition to those symptoms, Mr. Nelson rapidly develops anaphylaxis, a dangerous systemic reaction that causes a drop in blood pressure, difficulty breathing, swelling of the throat, tongue, and nose, and even loss of consciousness and could be life-threatening if unattended. This requires emergency medical attention.
Test results have been authorized for release by Mr. Nelson and are available to qualified medical personnel upon request.
