REPORTING OFFICER'S NARRATIVE(Brief narrative of the facts surrounding the offense and the arrest.)

At 1:43 a.m., I was on routine patrol when I observed an adult male pedestrian standing in the middle of the road in the 1200 block of East Pershing Avenue. I placed my patrol vehicle in park, activated my vehicle's emergency lights, and stopped approximately 20 feet from the male. At the time, the weather conditions were fair, and the ambient temperature was approximately 17°F/-8°C.

I exited my vehicle and identified myself as a Laramie County sheriff's deputy. I then asked the male, later identified by his Texas Driver's License as Darrell Beck, if he was in distress or needed assistance. Darrell responded with profanity, and his speech was slurred.

I approached Darrell, who continued to stagger on his feet but did not attempt to flee. I again asked Darrell if he needed assistance. Darrell again responded with profanity. I detected a strong odor of alcohol on his breath and asked if he had been drinking. In response, he asked if I was stupid and began shouting at some passersby.

I advised Darrell that I was taking him into custody for his own safety and instructed him to walk to my vehicle and place his hands on the hood. Darrell remained verbally belligerent as he approached my vehicle. Then he fell silent, stopped, and turned to face me. He asked if this was a dream or real life. I advised that it was real life and instructed him to place his hands on the hood of the vehicle. He complied.

At approximately 1:51 a.m., I placed Darrell under arrest with his hands behind his back, palms facing outward. I checked his handcuffs for tightness and fit and double-locked them for his safety. I searched Darrell incident to arrest and placed him in the rear passenger-side seat of my patrol vehicle.

At approximately 2:04 a.m., I transported Darrell to the Laramie County Sheriff's Jail for booking and intoxication testing.

DEFENDANT'S VERSION/REMARKS (What did the defendant say?)

During transport to the jail, Darrell made only one comment. "Am I dead?" After being advised that he was not dead, Darrell remained silent.
