REPORTING OFFICER'S NARRATIVE (Brief narrative of the facts surrounding the offense and the arrest.)

At 8:30 a.m., Reporting Investigators (R/Is) Detectives T. Armstrong and S. Murphy arrived at the arrestee's residence. Environmental conditions at scene upon arrival are as follows: Weather: Cloudy; Ambient Exterior Temperature: 57º F / 14º C; Relative Exterior Humidity: 82%

R/Is knocked on the door and Nelson answered. R/Is placed Nathaniel Harrison Nelson under arrest. Nelson was handcuffed and advised of his rights.

Nelson asked why he was being arrested and requested to call his father. R/Is informed him that he could make a phone call at the station after he had been booked. Nelson stated he wasn't going to say anything without a lawyer. Nelson was then escorted by R/Is to their department vehicle.

Transportation to the Sheriff's Department proceeded without incident. At 8:53 a.m., R/Is turned Nelson over to Sheriff's Department personnel for processing.

At all times while in custody, Nelson appeared lucid and coherent. Although uncommunicative, Nelson was cooperative and seemed to comprehend what was happening to him.

 

DEFENDANT'S VERSION/REMARKS (What did the defendant say about the offense or his/her whereabouts at the time of offense?)

Nelson remained silent during transportation to the station and during processing. Nelson refused to answer any questions until an attorney was present. However, Nelson did cooperate physically and did not resist in any way.

YOU ARE HEREBY COMMANDED, To arrest the above-named Defendant and bring him forthwith before the nearest available magistrate or other Judicial Officer of this State, to answer an indictment brought by the prosecutor in the attached affidavit, charging him with an offense of felony murder in the first degree against the person of Kristal Bentley Waterson on or about October 6, 2018 in the City of Oxford County of Yoknapatawpha. Herein fail not.

AFFIDAVIT

Personally appeared before me the undersigned Prosecutor, Calvin Dollarhide, Esq., who on oath says that to the best of his knowledge and belief, the above listed accused, between the hours of 6:30 P.M. on the 6th of October, 2018 and 12:30 A.M. on the 7th of October, 2018 did commit the offense of Murder,  in Yoknapatawpha County, Mississippi, against Kristal Bentley Waterson, victim, and against the laws of the State of Mississippi.

Prosecutor makes this Affidavit in order that a criminal warrant may issue for Accused's arrest.

Sworn to and subscribed before me this 28th day of June, 2004.
