Interview Summaries: Results of SUV Photo Lineup

Following multiple reports of sightings of a dark-colored SUV at locations associated with Andrew Fine and at times in the period when Fine was last seen, Detectives Armstrong and Murphy assembled a photo lineup composed of photographs of six dark-colored SUVs of different makes and models. The detectives then asked several witnesses who had seen the dark-colored SUV to examine the photo lineup and indicate whether the SUV they had seen was one of those pictured in the lineup or was similar to one pictured in the lineup. The following interview descriptions, provided in summary and not verbatim, provide the results of those photo lineup viewings.


On Friday, July 18, 2003, Officer Joe Wilkins of the Yoknapatawpha County Sheriff's Department contacted Detectives Armstrong and Murphy to report events he witnessed in the early morning hours of July 4, 2003, which he felt might be relevant to the Andy Fine homicide investigation. As a follow up to Officer Wilkins' report, the detectives asked him to view a photo lineup of six dark-colored SUVs to determine whether he could identify the vehicle he observed.

  • YCSD Officer Joe Wilkins -- reported seeing a dark-colored SUV in the parking lot of Papa John's Pizza at approximately 1:30 a.m. on July 4, 2003.

Officer Wilkins said that he had only caught a glimpse of the vehicle in question in the early morning hours of July 4. After viewing the photo lineup of possible vehicles, he said that, in his opinion, Vehicles C and D were larger than the vehicle he saw. Although he only caught a glimpse of the rear of the car as it was leaving the parking lot, his impression is that the vehicle he saw could very well be Vehicle E.

 

On Thursday, July 31, 2003, Detectives Armstrong and Murphy canvassed the residents of Oxford Chalet apartments, across the street from the Oxford Ridge apartments, where Andy and Cindy Fine's residence is located. Several witnesses reported seeing a dark SUV in the parking lot of Oxford Ridge in the early morning hours of July 4 and/or on previous or subsequent occasions. Those witnesses were asked to view a photo lineup of six dark-colored SUVs to determine whether they could identify the vehicle they observed.

  • Jose Lopez, 591 Hathorn -- said he observed from his apartment's window a dark blue or black SUV parked in the lot of Oxford Ridge apartments across the street from his residence at approximately 1:50 a.m. on July 4, 2003; added that he had also seen the same vehicle in the same location previous to that date.

After viewing the photos of six vehicles, Lopez said he thought Vehicle B was the vehicle he saw several times in the parking lot. He apologized that he was not familiar with makes or models of SUVs and that they all looked pretty much alike to him.

  • Raoul Jimenez, 310 Sisk -- said he observed a black SUV pull into the parking lot of Oxford Ridge apartments at approximately 1:40 a.m. on July 4, 2003.

R. Jimenez said he cannot tell for sure which of the vehicles in the photo lineup is the vehicle he saw drop off a passenger in the parking lot across the street from his brother's apartment on the morning of July 4. He said he got just a glimpse of the car that one time, it was from a distance and it was quite dark. From the pictures of the vehicles in the photo lineup, he thought Vehicle D was larger than the vehicle in question, but maybe the one he saw could have been Vehicle E or F.

  • Tito Jimenez, 585 Hathorn -- said he observed a black SUV pull into the parking lot of Oxford Ridge apartments at approximately 1:40 a.m. on July 4, 2003; added that he had also seen the same vehicle in the same location several times previous to that date.

T. Jimenez identified Vehicle A as the one he saw many times in the parking lot of his apartment before the morning of July 4, on the morning of July 4 and at least twice since July 4. He was positive of his identification, saying that since he works at Jo's Auto Clean Up Shop, he has washed and polished many Isuzu SUVs.

  • Jesus Ramirez, 581 Hathorn -- said he had often seen a dark SUV in the parking lot of the Oxford Ridge apartments, parked in approximately the same location each time; added that, each time he saw it, the SUV in question was occupied by a person he could not identify.

Although he had seen the vehicle in his apartments' parking lot many times before July 4 and once or twice since that date, Ramirez said he could not be absolutely sure from the photos which was the SUV he had seen. He thought Vehicles A, B, E, and F looked about the size of the vehicle, but other than that, he could not be more definite.
